Re-gazetting Pulau Kukup and others, Yeo Bee Yin and gang should support

This is the latest that I found on Pulau Kukup just now,

Dr M rebuts Johor crown prince, 

says federal govt not 'outsider' 


Well, I have a feeling that this is going to be another round of Dr Mahathir versus the Johor palace.

Anyway, yesterday,

Johor MB assures that Pulau Kukup 

remains a national park


But I guess that's not reassuring enough for a lot of people because the island will remain a Sultanate Land, which means it belongs to the Sultan.

Some people think that today, after all the pressure, the Sultan may want the island to remain a national park, but tomorrow he might decide otherwise.

The island now is his after all.

And how about the other national park areas in Johor?

If I'm not mistaken, the Tunku Mahkota Johor had said that those are also now Sultanate Land.

Other than those, I was also wondering how come the land was de-gazetted without going through the state assembly.

Why was it done quietly?

The Pakatan state government had tried to blame it on its BN predecessor but for that, I had discussed at this previous post,

Well, if Dr Mahathir really must insist on this issue, he should go all the way and force Osman Sapian as Johor MB to take back Pulau Kukup and the other national park areas in Johor from the Sultan.

Johor Pakatan government must re-gazette back the land to what it used to be.

That's the only way to make Pulau Kukup and the other national park areas safe.

They must belong to the rakyat and no one else.

All the famous and influential Pakatan bloggers must champion the take back of the land from the Sultan and give it back to the rakyat.

Castigating Osman and removing him from the MB post over the issue would not be enough as that could be seen as mere internal politicking.


Meanwhile, I was wondering how come the minister in charge of environment Yeo Bee Yin has yet to say anything over issue which involves the potential destruction of three Ramsar sites.

I googled "Yeo Bee Yin Ramsar" and at the top of the search is this,

I'm not sure how the hell that happened.

Anyway, it so happened that the minister is the MP of Bakri in Muar, Johor.

Surely she must have known something of what's going on in her own state.

Don't tell me, she's the same level as Osman and have the same excuse- "Oh, I was surprised. I don't know about it. It's BN's fault."

She should be pushing for Pulau Kukup and the other national park areas in her state to be re-gazetted back to what it used to be.

That would be better than doing nonsense such as twisting the findings of the committee that her own government set-up for the Lynas issue to suit her political agenda. (More of that later.)

And how about the other Pakatan environmentalist politicians?

Fuziah and Wong Tack should be making noises about this too.

So far, I have not heard anything from them.

Don't they want to save the environment like they do over the Lynas issue?

Ya, Fuziah should do another drama like swimming while crying around Pulau Kukup or something.

Or were all those nonsense over Lynas just for politics?

Sigh....and their supporters called me a hypocrite.

Whatever.

    The Cabinet on Friday had agreed that Pulau Kukup should remain a national park.

    So settled lah, finito.

    Funny thing, though....

    If Johor palace stays out of politics, then only it can ask Federal to stay out of Johor - but then, Johor IS part of Malaysia. For now...

      I think in Johor case, it is different.

      Johor state adopt the absolute monarchy, if I am not mistaken, so nothing the MB can do.

      The MB has no power.

      The Johor Sultan is like the Sultan of Brunei, he has all the power.

      That is why TMJ said, outsider should not interfere with Johor.

      I used to think the stupidest thing you've said so far is your Lynas "they said it was radioactive, but now they say it's the waste", but this beats it.

      So the Sultan can reverse a Federal decision to make Kukup a national park?

    5. You are indeed a stupid prick. Land matter is state's matter. The Federal government can say whatever it wants, but the land will remain a Sultanate Land. If the Sultan or his successors want to build a Disneyland on it later, they can do so. It's their land since it was gazetted to be so.

  3. Since it involves the Ruler, it is wise for all related parties to have an audience with him and discuss the matter. Just practise the Adat Melayu and insya-Allah, everything will be fine.

      But... many people said, Dr.M is mot 100% Melayu. There were 25% Indian blood running in his veins... so they say.

      Another ting is... "Insya-Allah" is an Arab phrase, which literally mean... May God Forbids or If God wills it... in English..

      Therefore, in the Melayu's context too, Insya-Allah signify pessimism and uncertainty over any outcome.

      Let me give you an example.
      Lets say, you invite someone for a kenduri and the fella replied... Insya-Allah.

      When a person say insyaAllah, it means if god permit, he will able to attend. So this shows that God is the true power of things. (Not the absolute monarchy)

      Then, there is a term called "Janji Melayu".

      Janji melayu or "malay promise" will depends on the probability, ranges from 0% to 100%.

      Janji melayu, most of the time, it will not happen.

    Therefore, the only way any land in any State could be rendered 'safe' for our future generation is to gazette it as state-land.
    Hence, State Assembly's approval becomes compulsory, before whatever status of the land were to be changed.

    For the first deal, Tabung Haji's shares in Bank Islam Malaysia Bhd (BIMB) were sold so as to show profit before being repurchased, which also incurred brokerage fees.


    PwC said it had also interviewed the Tabung Haji's equity traders, who admitted that the sale and repurchase of BIMB shares were only to show profit temporarily, so as to justify Tabung Haji's dividend payments.

    Earlier today, Minister in the Prime Minister's Department Mujahid Yusof Rawa, who is in charge of Islamic Affairs, confirmed that Tabung Haji had been in deficit since 2014 but continued to issue dividends, in violation of the Tabung Haji Act 1995."

    1. I dont know where this guy get this information that TH asset is less than liabilities..I have been perusing TH account for 2012 to 2017. I could not find in any financial year statement that their liabilities were more than asset.You can download TH financial statement from their website.

  9. Land in Johore belongs to Johore under the Ruler who delegates his power to the Menteri Besar to administer its affairs. Thus, the Federal and other State Governments have no right to dictate the management of land in Johore. Thus, National Land Code must be read together with the Johore State Constitution.

      It has zero to do with the Johor State Constitution.

      It's governed by Sultanate Enactment Act 1934 and the National Parks (Johor) Corporation Enactment 1989.

      The national land code 1965 exempts...

      (a) any law for the time being in force relating to customary tenure;
      (b) any law for the time being in force relating to Malay reservations or Malay holdings;
      (c) any law for the time being in force relating to mining;
      (d) any law for the time being in force relating to sultanate lands;

      And several others that existed before the FC.

      But that does not apply to land previously gazetted by the government for any purpose.

    Since we are a democratic country and the ruler is not absolute monarchy but instead a constitutional monarchy, If I understood correctly, one of the commentator said that the transfer of the land title is not legal.

    So, based on the legal framework of the land. Is the transfer of "Hutan Negara" Pulau kukup to an individual entity legal?

    If it is not legal, it should be corrected and amended yes?We do have law and order and what not yes?

      No, it's not unless such land falls under one of the categories in the exemptions to the NLC1965.

      There is no such thing, legally, as a "Sultanate Land Designated As A National Park".

      Tun M is quite correct in saying that the govt has authority over any land that does not fall within ungazetted categories in the NLC 1965.

  11. Annie, give coverage as well on the proposed degazettement and development of parts of Bukit Lagong Forest Reserve in Gombak. This is well within ph govn jurisdiction and no need to gadoh with sultan.

    I'm puzzled by the scope of responsibility of our environmental minister. Why not a pip squek from the minister on the degazettements? These ph ministers, soo obsessed with plastic bags and yet happy to import plastic waste into the country

  12. Land in Johore belongs to Johore. Although it is alienated or transferred to the Federal Government, the real owner is still Johore. Gazette of land also belongs to Johore. TMJ is right on this matter.

      b) Can the Sultan of Pahang declare any and all land in Pahang to be Sultanate land? (The answer does not depend on whether land is used / unused. It makes no difference.)

      c) How was land law changed in the pre-colonial era, by the Federal Constitution, and by the NLC 1965? Certain customary powers still exist - what are their limits?

      d) If the Pahang state government gazettes land for a purpose, can the Sultan there overrule it by decree?

    I think those de-gazetted Ramsar wetlands are gone - forever.

    I don't think the Sultan of Johor would be letting anybody get anywhere close to his property now.

    Maybe because she is an inexperienced Minister who probably does not even know what a Ramsar wetland is?

    I suspect this was why Osman Sapian, who is vastly more experienced and savvy in these matters of intrigue, has snuck this de-gazetting thru under her very nose.

    Why don't famous and influential UMNO bloggers also say something to their readers?

    For me, there is NO POLITICS as far as the environment is concerned.

    When it rains, you get wet, I get wet.

    When it floods, you get flooded, I get flooded.

    When the environment gets screwed, you lose, I lose.

    No, they won't.

    They are one-issue politicians and their one issue is Lynas - nothing more.

    I don't expect them to say very much.

    I suspect that like most Malaysians, Fuziah and Wong Tack know very little about the environment beyond their immediate interest, in this case, Lynas.

    In Malaysia, we do not have a political party which is totally based on the environment like those found in other western countries.

    I guess that is because very few Malaysians give a damn about the environment as a whole.

    That apathy is very clear to me given the lack of interest in the de-gazetting of the Ramsar wetlands.

  15. The Pakatan Johor state exco should have reversed the decision by the former BN state exco to de-gazette the status of Pulau Kukup as national park, not go ahead and formally de-gazette it's status.

    As it stands right now, by the Johor Sultan declaring Pulau Kukup as Sultanate Land, which shall remain a national park, is the only line of defense left to stop commercial developers from raping it.

    At the same time, the Johor state exco should move to re-gazette Pulau Kukup as a national park.

    I have seen enough of Pakatan state government practices in Selangor in the over 10 years of their rule over Selangor, to see that they are not very different from the former BN state government.

    Where Pakatan supported citizens opposed to federal projects in Selangor, was when the federal projects were BN federal government projects but now that both federal and state governments are under Pakatan, Pakatan aduns are acting very differently in response to residents' objections, which is not surprising, since individual Pakatan aduns and MPs will have to go against decisions by their own Pakatan governments.

    Many of my neighbours have noticed this difference in the responses of our Pakatan adun now compared to before GE14.

    Also, it looks like several Pakatan MPs are using their position as a platform from which to continue with their single-issue NGO activities, rather than to serve their constituents who voted them in.

    Like where are their objections over the proposed de-gazettement and development of parts of Bukit Lagong Forest Reserve in Gombak by a Pakatan government.

    I seriously doubt if Osman Sapian will do so.

    I am still rather partial to letting inexperienced Ministers get a handle on their jobs.

    Unless and until Pakatan and BN bloggers work together to use people power against an incumbent government, Malaysians will always be played off against each other on race, religion, politics, etc etc.

    No, they are not fakes - they are just one-issue politicians.

    They only have that one single issue because they are afraid of the spectre of radioactivity and they are not smart or scientific enough to understand what is going on.

    I do not blame anybody for being stupid.

    I do however get angry when they refuse to learn to get smarter but I know this is not right either because some people are just incapable of learning, eg mentally retarded people, people who do not have the resources, people who blindly follow the dictates of others, etc etc.

    In the case of Fuziah and Wong Tack, I consider them to be fully capable of learning, so let's see where we go with them from here.

    Personally, I believe that Lynas can be made 100% safe but I suspect the cost is going to be very high.

    This is where the review committee let me down - it did not address what it will take to make Lynas 100% safe.

    It's only solution? Send the waste back to Australia!!!

    Geez!! What a bunch of low class academics if you ask me.

    1. The solution given by Lynas review committee was not just to send the residue back to Australia as insisted by Yep Bee Yin. It's at point number 28 page 17 of the review committee report. Please read it yourself as I don't want to be accused of spinning it. Thank you.

    I do - the changes are HUGE in my kampung after 10 years of a Pakatan govt and given the recent PH win at federal level, the changes are gonna get even "huger" :)

    OK lah, can't share how it is gonna get "huger" because then you will know exactly where in Selangor I am from, sorry.

    Let's just say that a major infrastructure project, initiated by and supported by the community, will finally happen after 60+years of an UMNO/BN govt.

    I was not even born when the idea was first mooted!!!

    The only fucked up places in Selangor are the Wilayah Persekutuans, to wit, KL itself, which were formerly under you-know-who :)

    The simple answer to that is to vote the politician out in GE15, regardless of whether it is a PH or BN politician.

    The GE15 result will demonstrate the value of whatever project your neighbours are protesting about.

    Come on lah, is Gombak somewhere in Pahang near the Lynas plant? :)

    And why are we waiting for politicians to get involved?

    If we, as a people, don't care, why should any politicians?

    You, as a blogger, do have some followers and some friends amongst other bloggers (yes, I do know a bit about you, OK? ), so you are perfectly placed to do something about it.

    The environment is one area where Pakatan and UMNO/BN people can and should work together on, where we put aside our political differences, our racial differences and our religious differences.

    If this happened, Pakatan politicians will shiver with fear, and UMNO/BN politicians will learn how to listen to the people and how to serve the people.

    But, I don't think it will happen anytime soon because we, Malaysians, are not quite ready for this type of intensely close and intimate co-operation where your politics doesn't matter, your race does not matter, your religion does not matter.

    The anti-Lynas campaign was just a one-off event and is now closely associated with Pakatan, so forget that one.

    A political party purely based on the environment, with no allegiance to Pakatan or UMNO/BN or PAS or race or religion?

    Nah.. we are not quite there yet...

    Maybe, one day.... in 20 years time....

    Is that the bit about the flue gases?

    If so, there should be also something about discharged water.

    All in all, I feel that any specific conditions imposed should NOT be buried in masses of verbage but highlighted in big bold font.

    I dont really see any recommendations for the monitoring mechanisms either, which is disaapointing.

    It's like saying you MUST do this and do that but nothing is said about who is going to follow up or check or report to the rakyat.

    I still think that review committee has not covered enough ground.
