The need to maintain separation of powers

Yesterday, the Istana Negara issued a statement saying that the Yang diPertuan Agong has issued another decree, advising all MPs to support the soon to be tabled 2021 Budget.

I was a bit amused as to why the king needed to repeat that again.

I actually believe it was because he was not confident about all that talks of stopping the fight.

And I also think that the king agrees with me that all that talks of "political ceasefire" was actually just an

For some reasons that I could not think of, the statement issued by Istana Negara made it as if the  king was going out of his way in trying to save Muhyiddin's administration on this one.

And I do wonder why he didn't speaks directly about it as the statement was issued quoting the Royal Comptroller saying the king said this and that.

Hmmmmm....

Anyone who has been following this blog for a long time would notice that I quite like Sultan Abdullah, especially because of his hands on approach.

But he doesn't seems to be like that on this matter.

Well, maybe it's because of the protocol of Istana Negara.

Maybe.

Still, someone brought to my attention this morning that the king who is part of the executive shouldn't be interfering or in this case "advising" the parliament, which is the legislature on what it should or shouldn't do.

Doing so would infringe the separation of powers doctrine which is the pillar of our democracy. 

Under a democratic system, there must be a check and balance between the executive, legislature and judiciary. One of them shouldn't be let to dominate the others....like how it is in North Korea or communist-ruled China. 

My opinion on this matter is about the same as the following statement by Pasir Gudang MP Hassan Abdul Karim yesterday, 

Pekara: Hormati Kebebasan Ahli Parlimen Menentukan Pendirian Dan Membuat Keputusan 

1.Belanjawan Negara Tahun 2021 yang akan dibentangkan oleh Kerajaan pada 6hb November di Dewan Rakyat adalah dalam bentuk Rang Undang-Undang Perbekalan di bawah Perkara 100 Perlembagaan Persekutuan. 

2.Parlimen adalah badan legislatif iaitu sebuah institusi perundangan yang tugasnya menggubal undang-undang. Manakala ahli-ahli parlimen adalah penggubal undang-undang atau (laws maker). 

3.Negara kita Malaysia sebuah negara demokrasi berparlimen yang mengguna pakai prinsip pengasingan kuasa (separation of powers).Semua pihak dan institusi perlu menghormati parlimen dengan menyediakan suatu keadaan yang kondusif bagi membolehkan ahli-ahli parlimen bebas menentukan pendirian dan membuat keputusan. 

 4.Dalam hal ehwal kewangan negara, peranan parlimen amat besar.Perkara 96 Perlembagaan Persekutuan menyebut bahawa tiada percukaian melainkan jika dibenarkan oleh undang-undang. Manakala Perkara 102 pula menyatakan bahawa Parlimen mempunyai kuasa berkenaan dengan mana-mana tahun kewangan.  

5.Hal-hal berkenaan rang undang-undang melibatkan kewangan negara adalah dalam bidang kuasa parlimen. Tidak ada sesiapa boleh mengarah, mendesak,memujuk atau memaksa ahli-ahli parlimen supaya menyokong dan meluluskan sesuatu rang undang-undang belanjawan negara termasuklah Belanjawan Tahun 2021 yang akan dibentangkan pada 6hb November nanti. 

6.Peranan Parlimen sebagai badan semak dan imbang perlu difahami dan dihormati. Rang undang-undang belanjawan tahun 2021 seperti belanjawan sebelum ini perlu melalui proses penggubalan undang -undang yang diperuntukkan di bawah Perlembagaan Persekutuan dan undang-undang berkaitan kewangan yang sedia ada.Rang undang-undang belanjawan 2021 perlu dibahaskan di peringkat dasar dan jawatankuasa.Proses pengundian juga perlu dilakukan di peringkat dasar dan juga peringkat jawatankuasa.Tidak ada proses fast track ataupun jalan pintas.Duit beratus bilion ringgit dalam belanjawan negara 2021 itu adalah duit pembayar cukai dan duit hasil negara milik rakyat dan milik negara. 

7.Ahli-ahli parlimen yang mengangkat sumpah telah berikrar untuk mempertahankan Perlembagaan Persekutuan yang membawa maksud menjaga kepentingan rakyat dan negara.Ahli-ahli parlimen sama ada ahli Dewan Rakyat dan Dewan Negara berada di Parlimen atas kelayakannya menjadi ahli Parlimen di bawah Perkara 47 Perlembagaan Persekutuan.Justeru itu kepercayaan wajar diberi kepada mereka untuk menimbang mana yang baik dan mana yang merosakkan negara. 

8.Sebagai seorang ahli parlimen yang dipilih oleh rakyat, saya amat gusar dan bimbang dengan suatu kenyataan Istana negara bertarikh 28 Oktober 2020 yang dikeluarkan oleh Dato’ Indera Ahmad Fadil Shamsudin, Datuk Pengelola Bijaya Diraja yang menyebut, antara lain, bahawa Yang di-Pertuan Agong menasihati Ahli-ahli Dewan Rakyat untuk memberi sokongan padu kepada Belanjawan 2021. 

 9. Saya beranggapan kenyataan Datuk Pengelola Bijaya Diraja itu sebagai satu pelanggaran terhadap prinsip raja berperlembagaan dalam sebuah negara yang mengamalkan demokrasi berparlimen.Saya ingin menegaskan ahli-ahli parlimen mestilah bebas untuk membuat keputusan di dalam sidang parlimen termasuk sidang berkenaan Belanjawan 2021 tanpa ada sebarang tekanan atau pengaruh sesiapa (undue influence).

Well, I think it's best for us to defend our constitution and democratic system.

I do know that many of you all are fed up with the politicians these days but if we start to go down that slope, we may find it too slippery to climb up again.

Once we lose our democracy, we may never get it back.

      To add insult to injury, they tried to do a Mass Convoy to Kuantan to pressure YDPA.

      Alhamdulillah, our king is wiser than them.

      Tonight MTU is meeting.

      H2O is the man that Larut, Pagoh & Lobang Dubor want as DPM.

      He is the one who helped plan the Sheraton Move.

      If he succeeds, PPBM becomes much stronger, purely at the expense of UMNO.

      My suggestion is that H2O just leaves UMNO and joins PPBM directly.

      If you are after your own glory, then go run to AssMain's side.

      Tonight, we will find out whether the MTU has any wisdom or not.

      Will they allow H2O to sabotage UMNO?

      An Umno special supreme council meeting ended in the wee hours of Friday (Oct 30) with a declaration that the party remains committed to the current administration and would ensure that the federal budget is passed in Parliament.

      No mention was made of talk of a Cabinet reshuffle amid speculation that supreme council members would be trying to hammer out a deal with Prime Minister Tan Sri Muhyiddin Yassin as anticipation brews over the tabling of Budget 2021 next Friday (Nov 6).

      Hmmmmmmm.

      Either double bluff or the Haroon puppet has been told to withdraw charges.

    4. Zahid has no control left. But if you listen to Nazri, that is the true picture: "Once PRU15 comes, we will fight Parti Bunga".

      Next step is for Larut COVID Superspreader to block any MN registration UNLESS it has PPBM. That will force UMNO's hand. PAS are pak turut, they will choose UMNO (3mil voters) rather than Bersatu (200k members.)

      Muhyiddin will break Tun's record for shortest stint as PM. He will not survive 22 months.

  2. Masuk era Mahathir dan PH 22 bulan, sama juga..

    Dah dituliskan dolu dolu bahawa tolong angkat Raja Raja Melayu dan dijaga Agama Islam agar tidak diperlekehkan..apa Mahathir buat??

    ICERD mahu dipersetujui. Islam tidak dibenteng secukupnya. Orang Melayu diperlekehkan. Hal tuliskan jawi pun tak mampu dipertahankan. Raja Melayu pun dilongkangkan.

    Dah diperingatkan seawal 2019 sekiranya Mahathir gagal mengekang rakan PH nya dalam mencucuk' isu yang disebut diatas, nyawa Kerajaan Mahathir tak akan bertahan selama 24 bulan.

    Alhamdullilah dalam.masa.19.bulan.saja Kerajaan Mahathir iaitu Gabungan PH dijatuhkan sendiri olih Mahathir menebuk mukanya.

    Alhamdullilah, semuanya terjadi semahunya.

    Kali inipun serupa juga.

    Dah ditulis, GEMPAR 24 Oktober.

    Apa terjadi.. Muhyiddin dibutakan "mata dan hati" mengikut saja kehendak "melaun" untuk menyembahkan 'darurat" kepada YDP Agong.

    Kerana keromah pulang ke gagang Tanah bumi Melayu ini, dimana Raja Raja Melayu telah"diberikan hak sementara" untuk dijagai, maka, mengelupur Muhyiddin dan gerombolanya apabila menerima berita bahawa keinginan niat kelompok beliau ditolak olih Raja Raja Melayu.

    Adakah Muhyiddin masih mahu bersilat dan meneruskan 'niat'nya??

    Persidangan UMNO semalam juga telah membuktikan apa yang saya tuliskan. Tiada keputusan atau istilah meninggalkan PN buat masa ini. Malahan tarikh 30 Oktober adalah Hari terakhir untuk Muhyiddin membuat keputusan.

    Kalau nak selamat dan terus menjadi PM sehingga PRU 15,maka,lakukanlah seperti yang disebutkan.

    Kesemua dari UMNO yang sudah menjawat jawatan dalam Kerajaan Muhyiddin , tidak layak dicalunkan untuk mengisi jawatan TPM, kerana melebihkan kepentingan diri melebihi kepentingan rakyat.

    Dan ini pasti akan terjadi, iaitu "usikkan tangan ghaib" walaupun tidak secara langsung tetapi

    Cuma ada usaha tangan ghaib jawatan TPM dari UMNO calon yg datang dari paling 'bawah' semenanjung sana untuk dicalonkan sebagai khadamnya sebagai TPM Mahyuddin

Covid 19 has a fatality rate of about 8 per million of our population and fatality rate for road accidents stood at 250 per million population.Road fatality rate is more than 30x the Covid 19 fatality rate.However we have never heard of the Government wanting to introduce emergency measures to curtail the high road fatalities which have remained persistently high over the last decade .

    1. Road fatalities most of them died on the road - no need to get admitted & treated in hosp whereas those that contracted covid will get sick 1st & go to hosp to get treatment. They take up resources & could overwhelm our hospitals just becoz of the sheer numbers even if death rate is low.

      May I suggest anon 13:52 starts with yourself, your family & friends 1st if anyone of u has the misfortune to contract covid. Chances are 99% of u will survive so don't add to kkm's burden by going to the hosp. Win-win aaa...

    3. Our fatality rate is less than 10 per million. US about 600 per million S. Korea about 20 per million. They are not calling for emergency rule. Why should we. Are we that incompetant that we want to rule by degrees.

    4. THE reality is if you do not have majority you just ket it go. Do the honorable thing. Go to Agong and ask that those who command the majority rule the county for the rest of parliment life. No needs for election. As for budget, any tom dick and harry can do PN, PH, MN etc...We are not worry.

  4. It works both ways. If elements of the legislature were allowed willy nilly to make use of the Monarchy as we have seen in recent days to destabilise the country, why can't the Monarchy have a go at the legislature to stabilize the country?

    Annuar Musang (unofficial PPBM member) made a strange statement that MPs can "vote as they wish".

    I think Mookimak is still under threat.

    I am sure more patients involved in road accidents occupied hospital beds than covid19 patients unless KKM also used hospital beds to quarantine them.More than 80% of covid 19 patients have no symtoms or minor symptoms that dont require hospital beds.So the chances are very high that my family wont be requiring hospital beds if afflicted with covid 19 compared to us driving around in our cars everyday.

  7. Of course you’re right Annie ... knowing when and how much to intervene is almost a art and depends on judgement of,the wise ruler. Too much or too little and the result is never good. I,can see the motive for the Budget and how it seems like it’s ‘life or death’ but ... shouldn’t his majesty perhaps advise his PM to at least exhaust political means (Cross party discussion, political compromise, sideline the dalangs A and Z bla bla) Instead of running to the palace and seeking His Mjesty help just to do the basic job of being a PM ? I even dap, Aminah and some of the okra fellows seems to be respecting the advise and want to help- but you have to put some effort into doing your work laaaaa... Tak Malu ke Asyik Kena tunggu Raja dorong pi-dorong mai ?

  8. Kalau begitu, Agong mesti isytihar darurat sebab dalam hal ini, kuasa baginda ialah mengikut nasihat kabinet. Semua orang sokong keputusan baginda. Tapi bila Agong minta YB sokong rang undang-undang kewangan,ada bangkangan pula atas dasar perlembagaan. Ini agak hipokritikal.

    Kian lama kian berhasil ‘Langkah Sheraton’ yang membawa pada kejatuhan PH. Rupa-rupanya memang ada yang mengkhianati rakan-rakan dalam PH. Mereka kini menjadi antara pemimpin utama kerajaan yang memerintah selepas 1 Mac 2020, iaitu Perikatan Nasional (PN – Kabinet dibentuk pada 9 Mac 2020).

    Umno, seperti yang pernah diingatkan oleh Allahyarham Tuan Guru Dato’ Bentara Nik Aziz Nik Mat, hanya akan berbaik-baik dengan musuhnya untuk ‘naik’ dan ‘hidup semula’.

    Ia tidak jujur.

    Ketika ‘bernyawa-nyawa ikan’, Umno akan mencari ‘tonik’ biarpun dari pihak yang sebelumnya dimusuhi/dicaci. Walau bagaimanapun, setelah kembali kuat, ia ‘menendang’, malah membunuh ‘rakan sementara’nya itu, seperti yang dilakukan terhadap Pas.

    Muhyiddin dan Azmin kini dalam situasi bahaya pula.

    Sekali Umno di‘berikan muka’, ia akan ‘sudah diberikan betis, mahukan paha’ pula! Mereka kini terjebak.

  13. ASK current Government if they got emergency what they really can do to solve covid. Most is the same that they are going now. Emergency or no emergency they have limited options. What they want is nuclear option to fight assymetrical covid war which is Augustinian ghost not a manicheanian ghost.

  14. It is by no means certain that YDPA has the intention of meddling in politics, I believe. However, due to the pandemic and economic slowdown which continue to afflict each and everyone of us, perhaps His Highness felt compelled to propound an exhortation to all 222 MPs in supporting the Budget 2021 for the sake of people and nation. Maybe, for once and the 1st time ever, they should push aside the parliamentary democracy to allow the Budget to pass without any obstructions. Nobody can afford to shoulder the responsibility of any bleak outcome. Just not the time to play politics at a crucial time like now, but to unite and reconcile instead, to bring back the way of life that we used to enjoy before at the earliest possibility. So, time is truly running out for endless politicking. No ifs, buts and maybes, just an 'undemocratic' pass for the Budget in resolving this matter once and for all.
