Guan Eng's not very good day (updated)

The guy must be referring to AG Tommy Thomas' note on the PAC report, I guess.

Well, Guan Eng and Thomas should read this,

However, critics of Thomas’s argument say that he was not telling the truth for not reading Section 54 in its entirety.
Lawyer Fatihah Jamhari said if Thomas had done so, he would have realised that two sub-sections within Section 54 essentially allowed the previous government’s move of transferring the money into the consolidated account.
“Sub-sections 2 and 5 maintain the discretionary power of the (finance) minister  to determine whether to place the money under the Refund Fund and if so, at what rate and for how much,” points out Fatihah.
Below is what Section 54 and the sub-sections say:
Establishment of Fund for Goods and Services Tax Refund.
54 (1) A fund to be known as the Fund for Goods and Services Tax Refund (in this section referred to as “the Fund”) is established which shall be specified in and incorporated into the Second Schedule to the Financial Procedure Act 1957.
(2) There shall be paid into the Fund the amount of tax collected under this Act as may be authorised by the Minister.
(3) The moneys of the Fund shall be applied for the making of any refund under section 38 and Part VII.
(4) The Fund shall be administered by the Accountant General of Malaysia.
(5) Notwithstanding subsection (2) and the provisions of the Financial Procedure Act 1957, the Minister may authorise the payment into the Consolidated Revenue Account in the Federal Consolidated Fund of all or part of the moneys of the Fund.

Guan Eng didn't look so good yesterday.

Describing the move as “unprecedented”, the Singapore publication stated that the government early this month ordered global banking giant, HSBC, to transfer the funds held in  CPP’s account in Malaysia to  Suria Strategic Resources Sdn Bhd, which is wholly owned by the Ministry of Finance.

This is Dr Mahathir's answer on the matter

Looks like Dr Mahathir had to rescue his finance minister on that one.

However, noted was that Dr Mahathir didn't answer the question about under which law did the money was "seized" from the Chinese.

Well, I don't think the Chinese government was very amused with all that.

You take away the money in their account and put it in yours, you answer properly la.

After all the hard work by Daim and gang to be friendly with the Chinese so that we can do business with them, suddenly something like this pulak happened.

If I'm an investor, I don't think I'm very keen to do any deal in Malaysia after reading such a report.

If I'm the Chinese government, I may likely not be pleased that people simply simply take away money from my account. 

Anyway, why did Guan Eng looks like a really constipated boy yesterday?

PAC started its proceedings on September 12 last year, following statement made by Finance Minister Lim Guan Eng in the Dewan Rakyat on August 2018 which stated that RM19.4 billion in GST repayment was “robbed” by the previous government.
This was back then when Guan Eng got all stressed up and accused the previous BN government of robbing the GST refund money.

Sigh. What kind of finance minister lah this one.

Well, I believe it's not the only one that they lied about.

Even back then before GE14.

What to do, just bear with it lah for now.

    1. Sometimes we do agree Kluangman. Unfortunately Azmin is not the right candidate. He is just a politician that goes around trying to be popular. The right candidate is Mustapha Mohamad who is in PPBM now. He has got the right credentials and experience. The sooner the better...before negara bankrap.

  5. Aisay Annie...its all about semantics...robbed, diverted, misappropriated, misused etc. What is the bottom line? The money to pay for the refunds was not where it should have been and so honest taxpayers (the majority being non-Muslims...I hate to say this but I have to) were deprived of what was due to them. This is the bare fact Annie! You can accuse LGE of being constipated and likewise I can accuse you of verbal diarrhoea.

    1. if Malay gaji besar-besar, they also have to be taxed. Unfortunately most of them below par. Can suggest non-malay kerja with low-low income so that they will pay tax less. Pls stop claim only non-malay pay bigger tax. Ada baca rule ke tak? :-)

Money not lost...but spend.....That's not corrupt but donation....Lately, Najib said spend his 3.3 million credit card is gift to royalty...In the trial, witnesses mention that is not donation, but money from blackrock and seychelles....SPIN LA OH NAJIB AND GENG...SPIN SPIN SPIN...Where is LOBAKMAN? Going to Indonesia?

    1. Pretty naive comment. The majority of the PAC members are from PH. Unless they were sleeping on the job and signed it blindly the government should believe their own. If Tun does not believe his own prople please sack them. He twists and turns words and those who are naive and hold him in awe believe his twists. Like Hamidah Osman said 'It is better to be in Tanjung Rambutan than to be a liar'...

      You should be asking where is our Forex money....that was a real huge loss as confirmed by RCI.Tun was implicated in CBT. Offcourse now under PH the police investigation has been conveniently closed.

    4. In that Forex hedging losses... nothing went into anybody' personnel account.
      At that time, the Prime Minister did not played the role of Finance Minister, at the same time.

      Unlike 1MDB's, the Forex losses was discussed in the Cabinet and debated in Parliament.

    6. RD, 1MDB issue was investigated by PAC with 5 opposition MPs. Deputy Chair was from DAP. Forex RCI or PAC investigation was never done during Tun's time. Only a white paper written by Tun's men was presented at Parliment. The recent Forex RCI found the white paper did not tell the truth. Hence the CBT implications for Tun. Please get the facts. Dont just follow emotions.

    1. Prof, semua benda dia orang takut. Suruh buat RAC 1MDB tak nak. RCI or PAC for TH, Felda etc pun tak nak. PH hanya nak main persepsi dengan putar belit kata kata kat media. Mereka yg taksub PH atau Tun dengan lurus bendulnya telan segala putar belit ini...

    1. I think Tun may be agreeable to working with Tok Mat, BUT UMNO is now controlled by para penyamum, perasuah penyalah guna kuasa and facing court actions with record number of charges.

      So unless UMNO is cleansed of all these tainted crooks, it will be difficult for Tun to work with Tok Mat.

  13. Mohon pencerahan daripada pakar undang-undang. Is PAC legal?
    Bukankah tugas Dewan Rakyat untuk menggubal undang-undang? Apa peranan agensi-agensi penguatkuasaan dan Mahkamah sekarang? Nampak macam PAC dengan mudahnya boleh buat keputusan bahawa wang GST tidak hilang.

    Kalau PAC panggil agensi-agensi kerajaan untuk mendapatkan penjelasan berdasarkan Laporan Audit, yang itu saya faham.

    Tetapi sekarang macam ada dah tak kena. Dahlah ahli-ahli boleh keluar masuk jadi ahli PAC ikut sesuka hati, buat PC sana PC sini. But don't forget we voters out there are watching you irrespective of which political party you are from.
