Proposed anti-fake news law not so bad (updated)

Got a call from a friend over this issue yesterday evening.

He said he read this post and wanted to express his unhappiness with the proposed anti-fake news law.

My friend is actually pro-BN.

He said introducing such a law so close to the general election was wrong as it could backfire badly on BN.

"It will give ammo to the opposition for their campaign. No one likes to have his freedom restricted in any way. This is especially so among the young people," he said.

My friend is not trained in law like me but he has a good read of the law.

He said according to the bill, the law will give the Attorney General the power to decide what are fake news.

"That is bad. People are already complaining about the AG having too much power and here we are giving him even more power," he said.

My friend also suspected that the introduction of the anti-fake news law is just a continuation of the proxy war between factions in Najib's camp.

He said this part of the proposed law was likely designed to cut down to size members of a faction who have been using a prominent blogger based in UK to attack their rivals,

It covers all mediums and extends to even foreigners outside Malaysia as long as Malaysia or its citizens are affected.

Well, my friend does have a point there.

That part of the bill does look kinda weird.

By the way, I also found that many people are saying this about this issue;

The anti-fake news bill, which must be approved by parliament, calls for penalizing those who create, offer, circulate, print or publish fake news or publications containing fake news with a 10-year jail term, a fine of up to 500,000 ringgit ($128,000) or both.

The writer of the report is Eileen Ng. She used to be with NST, The Star and the now closed Malaysian Insider.

Used to be chummy with her, but we haven't seen each other for quite a while. Glad to know that she's with AP now.

Well, if you click on the link above and read the entire report, you may find that it's quite slanted to the opposition's side.

As for the opposition, they are meant to oppose this sort of things.

So, I'm not surprised that they are against this proposed law.

But never mind.

Actually, I'm also against any new legislation which further restricts freedom of speech and had feared the worst when the government said it's going to introduce this anti-fake news law.

However, I have seen the content of the bill for the law which was forwarded to me by a friend and have to say that it's not as bad as I had feared.

It's not like detention without trail for those suspected of writing fake news or something sinister like that.

To make it simple, I don't think I have to be scared of this law if I don't write anything fake.

It's nothing really new from the existing laws on the matter, actually.

Basically, it just said don't write or spread fake news or you go to jail or fined heavily.

I'm fine with that because I don't do this fake news business in the first place.

I always try my best to check the facts first before writing something serious.

If I'm not sure about something, I don't write about it.

For example, 1MDB.

I think we can write about the issue without making up things or simply believing in what were told to us by others

That would be the best.

Of course, the government guys shouldn't go around telling people that everything that is not coming from them are fake news.

That's stupid.

By the way, we need to also realise that the authorities need to similarly make sure a fake news is genuinely fake, before charging its author under such a law.

They can't simply simply charge people on this one, okay.

And if the mainstream media publish or broadcast fake news, they can also be charged under the proposed law.


You all who are unhappy with newspapers and television stations should keep a look out and lodge a report to the police or MCMC every time they publish or broadcast anything that could be fake news.

That would be fun, I think.

Whatever it is, I didn't see any provision in the proposed law which will make it very easy for the authorities to penalise people, what more if the person involved was innocent.

So, don't be too scared.

Bottom line is, just don't write or share things that we are not sure of.

We are after all responsible for what we tell others.

  1. The bill is unconstitutional. I personally think the law meant to intimidate people from speaking up, to subdue healthy discussions coming the elections especially during busy campaigning period. Sort of additional weapon to distort the free flowing of info.

    The people then will be frightened abd intimidated to share info. This is gross infrignment of their democratic right. The constitution has made it clear that one of the rights guaranteed is FREEDOM of expression.

    In this time and age where info, pictures and videos reach milions of people within seconds, and far-reaching, this new law acts to stifle it as if the people are so dumb and imbecile as to not knowing to differentiate between fact and fake. This is an insult to rakyat’s intelligent. The bill should be rejected in its entirety.

  2. FETED AND DELAYED IN WUNDERFUL PAKISTAN

    ..Our arrival in Pakistan on January 16 was a far more joyous occasion. We had entered from the Indian border town of Wagah and were greeted by office bearers from the Punjab Cycling Association, complete with garlands and armed security.

    We rode into Lahore escorted by two policemen bearing AK-47s on a motorcycle. The situation was rather amusing for Ving Lee and I at the time, given that we had cycled across Thailand, Myanmar and India entirely without escort of any kind, but when in Rome, I suppose?

    Our new friends from the cycling association were magnificent hosts and did everything they could to make our stay as pleasant as possible. No effort was spared in making us feel welcome, and we wouldn’t be exaggerating if we said we were literally feted by our hosts. 

    Prior to us arriving, we were warned by many people in India about how Pakistan is a dangerous country rife with terrorists. Even a Lama we met in New Delhi raised questions about the safety in Pakistan.

    Regardless of their concerns, we still had to travel through Pakistan as planned so we just took the concerns in our stride. A misconception perhaps, I wondered? 

    Most, if not all, of the Pakistanis we met inevitably asked us “So what do you think of Pakistan?”. Or “How do you feel being in Pakistan?”. You could sense that the Pakistanis were eager to disprove perceptions about their country and its people which they blame on the foreign media.

    I am fond of saying that the Pakistanis not only welcome you but will also grab you tight and smother as if to say “We’ve got you and we will take care of everything”. And, they mean everything. During our time in Lahore and other towns outside of it, we were well looked after in every aspect; accommodation, food and even the occasional sightseeing tour. Pakistanis are an obliging lot and will see to it that you have what you need.

    In the smaller towns outside of Lahore, we were not allowed to roam freely by ourselves and were confined to our room after sunset. We could only move around if accompanied by our hosts or by the police although never was there a time we felt unsafe to be on our own. Hospitality or paranoia, their concerns were nevertheless much appreciated. 

    The second most asked question to us in Pakistan would be “Are you Muslim?”. I guess it’s because they assume Malaysians would be Muslims  by default although the same question was asked of us often in India. 

    We had some frank discussions about Islam with our hosts and found out that there is no religious policing in Pakistan. Nor do the Pakistanis place much emphasis on halal/haram matters. The Pakistanis appear refreshingly liberal despite being an Islamic Republic.

    Also, I discovered that Dr Mahathir Mohamad is a household name among Pakistanis as they see him as a Muslim who brought much development to a third-world country. I delighted in telling them that Dr Mahathir and I share the same birthplace and attended the same school. 

    We had a string of productive activities while in Pakistan. We met journalists and even appeared on radio and television, speaking about our mission involving childhood cancer. We spoke to schoolchildren on a couple of occasions, too. 

    There is something quite impressive about the young in Pakistan. They seem to possess what I would call the three Es – enthusiasm, energy and enterprise. That they appear mature for their young age, which I’m sure is by design and perhaps culture.

    Fake news work only if readers are dumb and many Malaysians are dumb.

    Why are many Malaysians dumb?

    Because the system of education here is dumb.

    This is a no-brainer.

    The only people putting out fake news are those who are robbing 1MDB and telling us that no crimes have been committed and no money is missing.

    There is just way too many corroborating evidence out there by way of legal action by foreign countries and reporting by reputable newspapers.

    One would have to be really really gullible to believe that 1MDB is all fine and dandy.


    Anyway, I am not in the news game so I am not going to be affected by this fake news. I don't go around spreading fake news anywhere - not my nature.

    Most of what I share here are from my personal experiences - it's up to others to believe me or not.

  5. Annie, what does the bill say about proving that the person knowingly spread fake news? In the absence of details, we refer to what is known in the past few days. In one of the illustrations contained in Section 4 of the bill:

    QUOTE
    "(g) A gives a speech during a public forum held at a public place. In his speech, A informs that Z has misappropriated money collected for charitable purpose knowing that the information is false. A is guilty of an offence under this section."

    Now the opposition have been going around saying vast amounts of money have been siphoned from 1MDB and some of which was deposited in certain accounts and portions were used to buy jewellery for certain persons.

    And the govt. people have kept insisting that not a single sen have be stolen from 1MDB.

    Who, of these two opposing sides, is guilty of disseminating fake news?

    So we refer to the FAQ (Frequently Asked Questions) and answers on the Anti-Fake News Bill 2018 issued by the office of the Minister in the Prime Minister’s Department Azalina Othman Said.

      If 'not a single cent' was stolen from 1MDB, why no Audited Account Statement since Deloitte and its B.O.D declared statement for 2013 & 2014 as 'Can No longer be Relied Upon', a few days after DoJ's Civil Filing?

      Is it not a severe offence, as in The Companies Commission of Malaysia (SSM) laws, for a company without its yearly Audited Account, more so for 5 years, yet was still allowed to sell Rakyats primeland to foreigners to pay debt. Even to the extend... korek-lobang, kambus-lobang... borrowed RM2 Billion from Ananda Krishnan to pay debt.

    2. Regarding the 1MDB financial statements for 2015 and 2016, the Finance Ministry in a written reply in the Dewan Rakyat (November 20, 2017) to a question from Muhyiddin Yasin (PPBM-Pagoh) said :

      “On July 8, 2015, the police seized various original documents from 1MDB. Appeals by 1MDB management for the return of the documents have gone unheeded.

      “This has made it difficult for the auditors to complete the financial statements for the years in question as they need the original documents to proceed with their tasks.”

  6. To me, it will only open-up more avenues for corruption and misuse of power. Why waste time, creating something new when the existing laws is adequate enough?
    Take for example ISA and its supplement, Emergency Ordinance which was replaced by a more draconian SOSMA & POCA, but can be misused too.

    With the rate things are being swept under the carpet, coupled with an all-time low esteem the Rakyat have on the country's system of governance, this so called 'anti-fake news' law can also make DoJ's suspicion hardened into certainty.

    The only consolation, more income or revenue for lawyers and the government.

    2. I'm still wondering on what visa is Jho Low out of the country. He has been away for God knows how long. Can an ordinary citizen be issued with visas from various countries to be away for fun and enjoyment and to cruise in a yacht for such a long time? Can he enter Malaysia again? Even those who live in England, like RPK and Baginda and their families, on what grounds were visas issued? I've heard a lot of students and ordinary people are deported because of expired visa. Just out of curiosity.

    We see mans in authority around the world's (not in Malaysia)sustain to create fake news to legitimize their action ,on others or other country .

    In Malaysia ,I think it's better for the government to take action against fake product's ,so the people could benefit from it.

    If I am not mistaken, you don't need a visa to leave the country.

    For example, if you get into a sampan in Kuantan and start rowing into the Sth China Sea, you will eventually get to a point where you leave the jurisdiction of the Malaysian legal system.

    Of cos, this is assuming you don't give a shit about China's claim to the Sth China Sea, which I don't :)

    So, there you are, in international waters, in your sampan, and no visa, just like Fei Chai.

    You can stay out in international waters as long as you like or until your ikan masin supplies run out - no visa required.

    Of cos, you could go back to Kuanran for more supplies or the occassional nasi lemak before rowing back out again.

    You can do that as many times as you like, just carry your IC with you as per normal, OK?

    No visa needed for Malaysian citizens in Malaysian waters.

    Or you could decide to row to Sth Korea, for example, but pls keep to international waters and you will not need permission from anybody.... until you enter Korean waters.

    Once you enter Korean waters, then it gets messy.

    Are we talking Nth Korea or Sth Korea? :)

    Different entry visa reqmts for different countries, I think.

    I could go on and on but I hope you get the general picture.

    I am not a lawyer so if anybody wants to, pls feel free to correct me.

  14. On Tuesday, someone sent a message via WhatsApp that petrol price would shoot up on Wednesday, and I immediately saw people rushing to the petrol stations. Lucky I did not follow suit. The next day, someone said, "kena tipu". So, did the person intentionally do this to show the false essentiality of fake news legislation?

In 26 Jul 2016, Umno vice-chief Khairul Azwan Harun filed a police report against former Bank Negara governor Zeti Akthar Aziz, outgoing Malaysian Anti-Corruption Commission (MACC) chief Abu Kasim Mohamed and ex-attorney-general Abdul Gani Patail, alleging that they are involved in a conspiracy to topple Prime Minister Najib. In the end the report was dismissed.

    Isn't that more damaging than fake news? What do the 3 victims of this malicious action have to redress this injustice?

  17. I digress a bit from this fake news thingy, not that I don't care about it. I just think it's all crap nonsense cooked up by bn.
    I just want to say this. Way back when GE13 got done with, that guy who calls himself the pm of this nation asked, "what more does the chinese want?" The moment he asked that, I told myself that if a supposed leader can ask that, then he isn't fit to be our leader.

    And through the passage of time, he has proven himself to be just that, a totally unfit person to lead the country!

    But the best part is, now he's being called a thief internationally.
