Some went to my last posting about Dr Mahathir and Proton X70, which has nothing to do with Lynas, and started to bitch about that letter.
Ya, they did that despite claiming that they were tired of me writing about the Lynas issue which they said is outdated and boring.
The letter was quite long but basically, Yeo Bee Yin was telling the Lynas workers that she is sweet, nice and cares for them and that if they lose their job, it's because the Lynas management refused to take care of the residue of their plant in Gebeng Kuantan due to greed.
The Pakatan people were really lapping it up.
Especially, the part where Yeo Bee Yin said the amount of residue was so dangerously huge and that Lynas had promised to ship it to Australia.
Well, I don't actually want to write too much about it because I know the Pakatan trolls will just turn around and say I'm spinning (maybe even racial spinning too :).
So, since it's about the residue, lets look at what the Lynas review committee, which was set up by the Pakatan government and expert members appointed by Yeo Bee Yin herself, has to say about it.
This is from page 57 of the committee's report;
So how? Okay or not.
For the residue, got words such as "dikendalikan dengan sempurna" and "menunjukan hasil yang positif dan berpotensi untuk dikomersialkan".
The committee - (again I repeat) set-up by Pakatan government and members appointed by Yeo Bee Yin - said Lynas was doing exactly what they were told to do by the authorities and there was no danger from the residue of the plant. In fact the residue could even be turned into useful stuff.
The committee - (again I repeat) set-up by Pakatan government and members appointed by Yeo Bee Yin - went to the plant to check things out (properly I believe) and came out with the report, but of course Yeo Bee Yin, who has never been to (and refused to visit) the plant doesn't like it and made her own conclusions to suit her political agenda.
Yup instead of considering the committee's report, she straight goes to "you ship out the residue or we'll shut you down" and "you refuse to ship out the residue because you are greedy money grabbing bastards".

Anyway, for the part where she said she cares for the Lynas workers.....this one I have to laugh, okay.
She never even wants to see them.
Yes, Lynas invited her multiple times to visit the plant in Gebeng, Kuantan to check the place herself and also meet the workers there.
You know, any caring minister would have accepted the invitation. After all, the livelihood of hundreds of workers is at stake here and the welfare of their families will be affected.
But no....she didn't want to go. For her, Lynas and everyone associated with it are enemies. That's the DAP mentality as I understand it.
That's how she sees them from the start.
And when she sent in the committee, which members she herself appointed to check on the plant, she refused to follow its findings and recommendations, which didn't point towards the closure of those people's workplace.
Seriously, you all think she cares about those workers losing their job and finding it difficult to support their families. Think again. They are not even her type of people.
She tried to sound nice in the letter merely because that's the expected public relation exercise.
To me, she just sounds condescending.
If she is really sincere about those Lynas people, she should at least visit their work place, meet them and get to know them.
Then she would know that there are among those people whose livelihood she was tyring to take away for her political agenda, individuals such as a single mother who is rising seven children on her own, a man who lost his leg in an accident and given a job by Lynas at its office and a girl from one of the villages near the plant whose education was financed by the company since she was in school and later given a job there so that she could support her poor family.
There are many more such individuals working for Lynas and the orang kampung near the plant who support the existence of the Lynas plant there because it benefits their community. Yeo Bee Yin should meet and talk to them.
Those are real people, I'm talking about, okay.
Then again, I believe Yeo Bee Yin sees them as mere statistics that not worth her time to meet.
All that she cares for is the political mileage to be gain by shutting down those people's workplace.
And when she said in the letter that she is in Poland, I really laughed aloud.
Biodiversity conference or something....err, Yeo Bee Yin, you didn't tell people ka your own state of Johor got three Ramsar sites in danger?
Yeo Bee Yin, you stay there so long ka?
All those past months you can't see them? Why? So busy is it?
Hey Yeo Bee Yin, you are taking away their livelihood and causing them and their family to suffer and you didn't even bother to check on them.

Lynas refutes minister further
KUALA LUMPUR – December 14, 2018: Lynas Corporation Ltd. has clarified that the letters of undertaking concerning the removal of its residue that it signed in 2012 requires the company to first find out if the residue can be recycled.
If that fails, Lynas must then store the residue in a permanent depository facility (PDF), failing which the residue must be taken out of Malaysia, explained the company in a statement today following a claim that the letters were proof of Lynas’ non-compliance.
“The letter signed by the then Lynas executive chairman on February 23, 2012, explicitly states that Lynas Corporation Australia hereby gives a full undertaking to, if necessary, remove from Malaysia all wastes generated by the Lynas Advance Material Plant in Gebeng, Kuantan, during the temporary operating licence’s (TOL) period,” says the statement.
The Atomic Energy Licensing Board had issued three consecutive operating licences to Lynas — the September 2012 to September 2014 TOL, and the September 2014 to September 2016 and September 2016 to September 2019 full operating licences.
The issue of residue-removal non-compliance was highlighted by Energy, Science, Technology, Environment and Climate Change Minister Yeo Bee Yin yesterday when she questioned the commitment of Lynas to remove its residue from Malaysia.
While Yeo claimed that it would only cost Lynas about 10 per cent of its earnings to export the residue, the company retorted that her figures were inaccurate and that she misquoted the analysts who Yeo based her arguments from.
“The analyst also referenced Lynas’ security deposit paid to the Malaysian government’s AELB (not insurance) which had, as one of its purposes, the establishment of a permanent deposit facility.
“In reaching his view, the analyst had assumed that this deposit would be used to pay for some of the cost of exporting the WLP (Lynas’ residue), on the basis that a permanent deposit facility would no longer be required,” states Lynas.
The company’s latest tangle with the ministry happened after the latter ordered it to export its WLP residue which contradicts an independent review committee’s recommendation that the residue be permanently stored in a PDF, which it is currently working on.
In the review from the committee formed by the ministry, Lynas earned a favourable verdict and was vindicated from any malpractice but yet the ministry made decisions contradicting the committee’s findings and recommendations, something which Lynas finds most inappropriate.

(I think you would have seen the “hills” of residue accumulated at LAMP.)
As of now, there is no viable near-term solution to manage the accumulated residue, which is stored at the open landfill temporary site.
The risks to the surrounding communities and environment increase with the increasing amount of accumulated residue as it is exposed to the threat of natural disasters such as major flooding.
Your employer has twice made the commitment to the government of Malaysia to remove waste from Malaysia. If you have not seen this, attached are the letters of undertaking written by Lynas Corporation Ltd, Australia (Lynas Australia) and Lynas Malaysia Sdn. Bhd (Lynas Malaysia) dated February 23, 2012, and March 6, 2012, respectively, indicating their commitment to removing LAMP residue from Malaysia, if necessary. Considering the risk of the residue accumulation, it is now “necessary” to do that.
What’s the cost for Lynas to remove the waste out from Malaysia? Australian Financial Review reported the following:
“CLSA analyst Dylan Kelly said in a note to clients that the cost of transporting the waste back to Australia was estimated to be US$60 million, but said insurance would cover about US$46 million of that. The balance of about US$14 million would represent about 10 percent of the earnings before interest, tax, depreciation and amortisation of US$129 million that Lynas recorded in 2017-18.”
I really hope you can put things into perspective according to these figures - it only takes 10 percent of Lynas earnings of one year to send out waste that has been accumulated in Malaysia for six years.
Even after the ministry sets the requirement of WLP waste removal from Malaysia, brokers like UBS and CLSA still kept their recommendations “buy” on Lynas stock. UBS even set US$3.10 price target on the stock, which is nearly double the current share price."
What these show you is that the whole drama the Lynas management is trying to stage – the myriad of paid advertorials in all major newspapers, the press conferences that paint a bad picture of the ministry and so on, eventually boils down to this: to protect the company by not honouring the commitment made. As a minister, my job on the other hand, is to protect the public interest and people of Malaysia.
I would like you to know that I did not ask more than what your employer had committed back in 2012. Therefore, it is my hope that Lynas will honour their words and start the process of shipping out WLP residues from Malaysia.
I hope this decision also sends a message to the next generation that this generation of Malaysians is doing the best we can to leave the country a better place for them to live in."

a) The recycle option was a complete failure despite the claims made in advance by Lynas. That is WHY there is now a stockpile many thousands of times in excess of the limits.
Need me to explain this "recycling" further? Boleh!
b) The "dikendalikan dengan sempurna" which you quoted refers to the RSF, i.e. the on-site waste dump. This is NOT the PDF (permanent disposal facilities) that is required. A PDF - as the name suggests - it a safe way of containing waste. An RDF is just an onsite holding area. NOT what they were told to do.
c) Export - like Yeo says, it takes 10% of Lynas's money to remove this mountain of dangerous crap from Malaysia. So do it, lah.
If Lynas wants to save the jobs of its workers, the path is clear.
They have 3 ways to do so.
What are they waiting for?
The review committee members, who were appointed by Yeo Bee Yin visited the plant (which Yeo Bee Yin refused to visit) and saw the "mountain of dangerous crap" and checked on it and said the Lynas operation is safe. Eerrr....how come?

a) These matsals have been lying through their ass literally from day one.
b) They happily claimed "don't worry, we will recycle 100% of our waste, so need for that expensive PDF or export, you brown-skinned idiots just relax, OK?"
c) This was a lie.
d) Since 2012 - close to 7 years ago - Lynas has achieved almost zero recycling, DESPITE claiming that by 2015 it would be full commercialisation and recycling of residues and there was no need for PDF (yes, correct - these fuckers are just trying to save money.)
e) Lynas claimed the 100% recycling would be for plaster board and cement manufacturing, road base, fertilizers, and soil remediation. None of this came true. They "invented" one soil enhancer that uses very little of the most dangerous residue, WLP.
f) These "advanced" (konon) matsals even subbed out the R&D to UKM to try and find a solution. In 2014, an experiment to extract radioactive thorium from the most dangerous residue, WLP, proved to be impossible. However, the experiment did reveal that the radioactivity of WLP was much higher than that declared earlier by Lynas. Whoops, backfire lah.
g) The Lynas report was very fair and objective, and quoted many different bodies.
h) In Malaysia, waste is classified legally into various categories. Because WLP has a radioactivity of 7.98 Bq/g, it is classified as hazardous. Hence (AGAIN), all the shit that Lynas produces MUST be removed OR stored in a PDF. And they have known that from Day One.
i) Legally you can accumulate 20 metric tonnes of such waste for a limit of 180 days.
Lynas has accumulated....

In my view, they are being TOO lenient with these people.
The fact is, Lynas was given a clear path to compliance since 2012.
It failed, lied, postponed.

Instead, they have now been given 3 chances to survive.
If they don't take them...
...they can blame themselves.
If the workers lose their jobs...

From what I can tell, she is just asking Lynas to honour its agreement to ship the waste out of Malaysia.
But you pointed out that the waste can be commercialised.
If so, why isn't Lynas commercialising it and selling it, thereby reducing the waste stockpile?
Is nobody interested in whatever commercial product from that waste?
As for any displaced employees from Lynas, it will be tough to address this.
On the one hand, we should not just be throwing ppl out on the streets, but on the other, we cannot allow, what is believed to be an unsafe Lynas plant to keep operating.
Lynas has claimed that its plant meets the highest standards of safety - domestically and internationally.
I think this is the angle which Lynas should continue to work on.
Not only should Lynas just use glitzy marketing to sell the safety message but it may want to organise public tours, maybe publish daily safety reports like sample testing results, provide monthly updates, etc etc.
Lynas needs to, somehow, overcome the fear which ppl have of radiation poisoning from its operations.
It is no good for Lynas to just try to convince the Minister how safe the plant is.
Lynas has to also convince the man-in-the-street as well.
Why invited just the Minister?
Invite us, the normal every day Malaysian, who are afraid.
When we, normal every day Malaysians, are afraid, the Minister had better be afraid as well, becos we can sack the Minister at the next GE.
I desperately want Lynas to remain open because it has a unique niche in the market place and can bring in lots of badly needed money to the Malaysian economy.
But I also want it to be done properly.

- Lynas invited everyone to visit the plant. Go and check with them. But of course when you visit any industrial plant you have to adhere to the safety protocols.

This must be one of the stupidiest statements from Annie. Shutting down Lynas means a loss of precious tax revenue for the government.

Firstly, I feel a monthly check is grossly inadequate.
I think that an absolute minimum is a daily chk. I am even thinking hrly chks may be necessary for some processes.
I dont believe that for something like this, any good scientist would consider monthly checks to be enough to make any meaningful short-term conclusions.
As for checking on the sample readings taken by the various govt agencies, I am sorry I was simply not good enough to find out where they are published.

I didn't know that and I don't think many Malaysians know that either.
Perhaps Lynas should promote such public tours a bit more??
I'll ask around in my kampung if they have heard of such public tours offered by Lynas.

If I am not mistaken, Lynas HAS NOT breached the law.
It appears that Lynas is legally permitted by the Malaysian Govt, albeit the previous Najib administration, to increase the waste stockpile.
Speaking of the waste stockpile, I understand it consists of thorium.

Thorium does have a commercial value but unfortunately there is little demand for thorium at the moment because the technology is simply not there to extract and use thorium efficiently and effectively.
I recall reading somewhere some years ago that thorium could be the next "magic fuel" for nuclear power stations because it has some significant advantages over uranium.
The Wikipedia mentions that there are a number of thorium-power nuclear reactors in existence.
My guess is that the low number of thorium-powered nuclear reactors is due to the many technological difficulties in extracting thorium easily and cheaply - at the moment.
And yes, thorium is radioactive and can cause problems to humans.
I have no idea what percentage of thorium is in that waste stockpile.
So far, it appears that Lynas can't recycle that waste stockpile, so the next step is to store it in a PDF.
If Lynas does built a PDF, it would have fulfilled its legal obligations and it would seem very difficult for Yeo to shut it down.
So, the answer to saving the jobs of those workers is for Lynas to just built the PDF, right?
Maybe, Lynas does not want to built a PDF, in which case, it has to ship the waste out, as that is what it is legally obliged to do so.
Correct me if I am wrong but those are the only three options which Lynas has with regards to the waste, right?
Recycle, store safely or ship out.

From what I can tell so far, what the Minister is not interested in is of little relevance.
Lynas appears to have a strong legal footing in the PDF option.
So, all Lynas has to do is to build that PDF and it is end of story.
Not sure why Lynas is taking so long with building this PDF as it would give certainty to its worried workforce.

Personally, I think this is a frivolous matter to file with MACC.
I find it hard to believe that Lynas would engage in corrupt practices.

The processing plant is an opportunity for Malaysia to capture a slice of the global rare earths market.

Not really true.
From what I understand, Lynas did try to find ways to recycle but the waste was notoriously hard to recycle, eg it is simply not profitable, at the moment, to extract thorium from the waste.
Also, no other useful products could be made from the waste either.
So, this leaves just the PDF.
Why Lynas has not chosen to built the PDF is a bit of a mystery.

It can bring about the converse question - "Which Pakatan crony will benefit from a Lynas closure?".
Notwithstanding the converse question, I am certain that if there is a Najib crony behind Lynas, Pakatan is now in power and thus has the perfect opportunity to expose him/her.
To date, we have heard nothing about any involvement by Najib cronies nor of Pakatan cronies.
Personally, I think the Lynas debacle is simply a very unfortunate affair, badly managed by the Lynas management and the previous UMNO/BN govt.
Lynas took advantage of the useless lazy morons in the UMNO/BN administration and delayed building that PDF for as long as they could.
I still believe that Lynas can save the situation by building the PDF.
I believe that Lynas is fully capable of providing world's best management of a rare earths processing facilty.

I suggest you don’t believe what anyone has written and do your own research. All PhDs in these areas will say is that the amount of radiation is minis cue and are not considered harmful.
What is harmful is that the three politicians are not telling the truth and misleading the public. Corrupt government?
